Donating a kidney is one of the most altruistic actions a person can take, and being a living organ donor is much easier when laws are in place to protect you, such as guaranteed paid leave from work to recover from surgery and protection from discrimination by life, disability and long-term care insurers. AKF has been leading efforts at the state and federal levels to secure these protections through legislation, and thanks to our groundbreaking Report Card, significant progress has been made in the states. The recent passage of legislation in Delaware, Florida, Georgia, Louisiana, Minnesota, Nebraska, Ohio and Virginia has moved the national grade average from a D to a C. But with more than 106,000 people waiting for an organ transplant—including nearly 92,000 who are waiting for a kidney—it is clear that much more needs to be done. Until federal legislation is enacted to give baseline protections to living donors nationwide, states are operating with a patchwork of living donor protection laws.
